staticsites.eu is not open yet and nothing on this website can take a payment. The sections below about subscriptions, payment and refunds describe how the service will work, and they take effect for you when you open an account, not before. They are published now so that nobody has to join a waitlist and find out the terms afterwards.

When you use our website, our service or our software, you agree to these terms and to our privacy policy, which tells you how we handle your data.

If something here does not work for you, write to us before you sign up rather than after. We would rather fix a term than argue about one.

staticsites.eu Terms of Usage (“Agreement”)

Please read these Terms of Usage (“Agreement”, “Terms of Usage”) carefully before using https://www.staticsites.eu (“our site”, “our service”, “our services”), operated by Essential Code GmbH (“us”, “we”, “our”). This Agreement contains the legally binding terms and conditions for your use of our services. Our company details are in the imprint.

General conditions

You must be human and legally able to form a binding contract. Otherwise you need to be directly supervised by a parent or guardian who agrees to these terms. By using our service you agree that this is the case. We reserve the right to refuse service to anyone, for any reason, at any time.

You may operate the service through an AI agent, and the service is deliberately built so that you can. Doing so does not transfer any responsibility: whatever your agent does with your token, you did.

The waitlist

Joining the waitlist means giving us an email address so we can tell you when staticsites.eu opens and what it costs. It is not an order, it does not create a contract, it does not reserve capacity, and it obliges neither of us to anything. It costs nothing and there is nothing to cancel.

You can be removed at any time by emailing hallo@essentialcode.eu. We will not sell your address, pass it to anyone for their own marketing, or use it to send you anything unrelated to staticsites.eu.

Your account, your content

You are responsible and liable for any activity that occurs under your account, even if someone else causes it. That includes anything you or your agent deploy through us: pages, files, images, code and anything else that ends up being served.

You are responsible for any infringement of copyright, contract rights, intellectual property rights, privacy or publicity rights in the content you publish through our service. By using staticsites.eu you confirm that you have the rights to everything you upload or connect. We are not responsible for claims and expenses arising out of your violation of this Agreement.

We claim no rights to your content. Your site is yours: the code, the text, the images, the design. We store it and serve it, and that is all. If you leave, you take it with you.

Keep your token secret. API tokens and account credentials must not be shared with third parties. A token can create and destroy sites, so treat it like a password.

What you may not publish or do

We do not tolerate using our service to discriminate against others, in particular on the basis of race, sex, sexual orientation, disability, health, age, religion, ancestry or national origin. You agree not to publish content that is illegal, harmful, abusive, threatening, invasive or hostile, and to ensure your content is not obscene or inappropriate for people under 18.

Because we serve your pages publicly, the following are also prohibited:

  • Phishing, malware distribution, or pages designed to impersonate another person or organisation
  • Using the service as general file storage or a media delivery network rather than to host a site
  • Reselling capacity or making your account available to unauthorised parties
  • Deliberately impairing the service, or using it to attack, scan or overload anyone else
  • Gambling and betting, terrorism, the creation of “fake news”, and military use

We reserve the right to remove content, or to suspend or terminate an account without prior notice, if it violates these terms, is unlawful, or is disruptive to the service. Where it is safe and lawful to tell you first, we will. We will not be liable for consequences of the loss of content or the termination of an account.

Limitation of liability

We are not liable for any direct, indirect, incidental, special or consequential damages, including but not limited to loss of profits, revenue, data or data use, business interruption or loss of privacy, arising out of or in any way related to the use of or inability to use the staticsites.eu service or any content provided on or through the site.

In addition, liability is excluded unless the damage has been caused intentionally or through gross negligence. This does not apply in cases of loss of life or damage to the health of a person.

Our liability is in any case limited to EUR 100.00.

Fees and services

All references to fees for the staticsites.eu service are in Euro (EUR, “€”).

Taxes and other expenses

Our fees are exclusive of value-added tax, except as expressly stated to the contrary. On your invoice, the VAT may or may not be stated depending on where you are situated and whether you are a private or a business customer.

Be sure to enter everything your invoice needs for tax purposes in your settings.

Subscription

The pricing of our subscriptions is subject to change, which could be reflected on your account in the future. We will give you prior notice of any change in pricing that affects your account, so that you have the opportunity to cancel in time.

Plans include a monthly allowance of bandwidth. Usage above that allowance is billed at the overage rate published for your plan.

Free trial

We may offer subscriptions with a free trial for a limited period and with limited access to certain features. The trial runs for 14 days and covers one site, served on a staticsites.eu subdomain rather than a custom domain. We reserve the right to modify the conditions of, or cancel, our free trial offer.

Monthly subscription

If you have chosen a monthly term, your subscription continues month to month unless and until you cancel or we terminate it. You must cancel before it renews each month in order to avoid being billed for the next month. Renewals occur on the month anniversary of your initial purchase date.

Payment method

We do not handle payment information on our servers. Payment is processed by Paddle.

Paddle is the merchant of record for your purchase. That means your contract for the purchase itself is with the Paddle entity named on your invoice rather than with us, and Paddle is responsible for charging you, for invoicing, and for collecting and remitting sales tax and VAT. Your agreement with us for the service itself, set out on this page, remains with Essential Code GmbH.

For buyers outside the United States, that entity is Paddle.com Market Limited, 30 Old Bailey, London, EC4M 7AU, United Kingdom. For buyers in the United States it is Paddle.com Inc. Your invoice names the one that contracted with you.

All payment information is subject to the privacy policy of Paddle or of any other payment provider as applicable. A valid payment method is required to process the payment for your subscription. You agree to provide accurate and complete billing information and authorise the collection of all subscription fees incurred through your staticsites.eu account.

If a payment is reversed or charged back, we may suspend the account until the matter is resolved.

Refunds, cancellation, warranty

All services are provided “as is” without warranty of any kind, including but not limited to fitness for a particular purpose.

There is no cancellation fee. You can cancel your subscription at any time, and you keep access for as long as you have paid for in your current billing period. The free trial exists so that you can evaluate the service before paying anything.

Where you are a consumer in the EU, your statutory right of withdrawal applies and is not affected by anything on this page.

Scope of licence

By signing up for our service, we grant you a non-transferable, non-exclusive, revocable and limited licence to access our services through the dashboard, the API and the MCP server.

Access to and use of our services is licensed, not sold. You do not buy ownership. This does not affect your ownership of your own content, which is covered above.

What the service does and does not do

Stated plainly so that nobody signs up on a wrong assumption. staticsites.eu hosts static sites: pages that are built once and then served. It does not run application servers or databases, or anything that executes per request. Custom domains are supported as subdomains pointed at us with a CNAME record, not as root domains, because the DNS specification does not permit a CNAME at the root of a domain.

Unavailability of service

We aim to run a service that is available as continuously as possible. You acknowledge that from time to time it may be inaccessible or inoperable, for reasons including but not limited to:

  • Hardware or software malfunctions
  • Maintenance procedures or repairs
  • Causes not reasonably foreseeable or beyond our control
  • Capacity limits at a supplier, which can cause builds to queue

Unless a service level agreement has been agreed with you in writing, no availability figure is promised.

Fonts and assets on this website

The typeface used on this website is Inter, licensed under the SIL Open Font License and served from our own infrastructure rather than from a third-party font service. Nothing on this website loads assets from an external content delivery network.

Our service and this website contain links to third-party sites that we do not own, including our own suppliers and the provider of the waitlist form. We have no control over and no responsibility for the content, privacy policies or practices of any third-party site or service. Please read the terms and privacy policy of any third-party site you visit.

Data protection

By signing up for staticsites.eu you agree that your personal data (name, email address, billing address and details, VAT number where applicable, the domain names you configure and the content you deploy) will be collected, stored and processed electronically in order to provide the service.

We may send you email about deploys, billing, security and the service in general.

Governing law

This Agreement is subject to the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence.

Severability clause

Should a provision of these conditions be or become void, this shall not affect the validity of the other conditions or of the Agreement.

Changes to this Agreement

We reserve the right to change, modify or replace these Terms of Usage at our sole discretion by posting the updated terms at https://www.staticsites.eu/legal/terms/. Where a change materially affects a paying account, we will give notice before it applies. Please review this Agreement periodically.
